Conditions of participation

Par­ti­ci­pa­ti­on in the raffle of Magne­sia GmbH, her­ein­af­ter refer­red to as ope­ra­tor or orga­ni­zer, is free of charge and is gover­ned exclu­si­ve­ly by these terms and conditions.

Expiry of the raffle

The dura­ti­on of the com­pe­ti­ti­on extends from 08.10.2018 00:00 until 10.10.2018 16:00. Within this period, users will have the oppor­tu­ni­ty to par­ti­ci­pa­te in the raffle online.

Participation

In order to par­ti­ci­pa­te in the raffle, it is neces­sa­ry to com­ple­te and submit the dis­play­ed par­ti­ci­pa­ti­on form. Par­ti­ci­pa­ti­on is only pos­si­ble within the par­ti­ci­pa­ti­on period. Sub­mis­si­ons recei­ved after the closing date will not be con­side­red in the draw.

Only one sub­mit­ted appli­ca­ti­on will par­ti­ci­pa­te in the com­pe­ti­ti­on per par­ti­ci­pant. It is strict­ly for­bidden to use mul­ti­ple email addres­ses or login names to increase your chances of winning.

Par­ti­ci­pa­ti­on in the com­pe­ti­ti­on is free.

Eligibility

Eli­gi­ble for par­ti­ci­pa­ti­on are natural persons who have reached the age of 18 years. Par­ti­ci­pa­ti­on is not limited to cus­to­mers of the orga­ni­zer and does not depend on the purcha­se of a good or service.

Should a par­ti­ci­pant be rest­ric­ted in his busi­ness ability, it requi­res the consent of his legal representative.

Not eli­gi­ble to par­ti­ci­pa­te in the com­pe­ti­ti­on are all persons and employees of the ope­ra­tor invol­ved in the con­cep­ti­on and imple­men­ta­ti­on of the raffle and their family members. In addi­ti­on, the ope­ra­tor reser­ves the right, at its dis­cre­ti­on, to exclude persons from par­ti­ci­pa­ti­on if jus­ti­fied reasons exist, for example:

(a) in the case of mani­pu­la­ti­on (b) in the event of a breach of these Terms of Par­ti­ci­pa­ti­on, © in the event of unfair­ness or (d) in the case of false or mis­lea­ding claims in con­nec­tion with par­ti­ci­pa­ti­on in the raffle

Profit, notification and transmission of the prize

The fol­lo­wing prizes will be awarded:

The winners will be deter­mi­ned after the closing date of the entry as part of a random raffle among all par­ti­ci­pan­ts. If the raffle is linked to a task, only those par­ti­ci­pan­ts who have com­ple­ted the task cor­rect­ly will enter the raffle.

The winners of the raffle will be announ­ced at the jubilee party for the 35th anni­ver­sa­ry of Magne­sia GmbH on 10/10/2018 begin­ning 3 p.m. at Magne­sia stand 8A101. As the hand-over will also take place during the party, only par­ti­ci­pan­ts who are present at the event can win prizes. If there is no exactly correct answer, the closest guess wins. With several present winners the lot decides.

An exch­an­ge or cash payment of the prizes are not pos­si­ble. Any addi­tio­nal costs asso­cia­ted with making use of the prize shall be borne by the winner. The winner is respon­si­ble for a pos­si­ble taxa­ti­on of the profit.

Termination of the raffle

The orga­ni­zer express­ly reser­ves the right to ter­mi­na­te the com­pe­ti­ti­on without prior notice and without giving reasons. This applies in par­ti­cu­lar to any reasons that would disrupt or prevent a planned course of the raffle.

Data protection

For the par­ti­ci­pa­ti­on in the raffle the indi­ca­ti­on of per­so­nal data is neces­sa­ry. The par­ti­ci­pant assures that the infor­ma­ti­on pro­vi­ded by him about the person, in par­ti­cu­lar: first, last name and email address are true and correct.
The orga­ni­zer points out that all per­so­nal data of the par­ti­ci­pant will not be passed on to third parties without consent.

The winners agree to the publi­ca­ti­on of their names in the announce­ment. This includes the announce­ment of the winner on the website of the ope­ra­tor and his social media plat­forms.
The par­ti­ci­pant can revoke his declared consent at any time. The revo­ca­ti­on must be addres­sed in writing to info@magnesia.de After revo­king the consent, the coll­ec­ted and stored per­so­nal data of the par­ti­ci­pant will be deleted immediately.

Applicable law

The raffle of the ope­ra­tor is subject exclu­si­ve­ly to the law of the Federal Repu­blic of Germany. The legal process is excluded.

Severability clause

If any pro­vi­si­on of these terms and con­di­ti­ons be or become invalid in whole or in part, this shall not affect the vali­di­ty of these terms and con­di­ti­ons. Instead of the inef­fec­ti­ve pro­vi­si­on, the legally per­mis­si­ble pro­vi­si­on which most closely appro­xi­ma­tes the meaning and purpose expres­sed in the invalid pro­vi­si­on shall apply. The same applies in the event of the exis­tence of a loopho­le in these con­di­ti­ons of participation.
